- Temporary assignment of work (assignation temporaire)
- An employer may temporarily assign work to a worker who has suffered an employment injury, even before the injury has consolidated, if the health professional in charge believes the worker is reasonably fit to do it, that it poses no danger given the injury, and that it favours rehabilitation (LATMP, s. 179). The professional’s favourable opinion must appear on the form prescribed by the CNESST. As a rule, the employer pays the worker the salary and benefits attached to his or her employment (s. 180).

- Tender (soumission)
- A written offer in which a contractor undertakes to carry out the work described in the tender documents for a set price and on set terms. Under the Civil Code it is an offer to contract: if it carries a term for acceptance, it cannot be revoked before that term expires (art. 1390). Its acceptance forms the contract.

- Tender security (garantie de soumission)
- Security attached to a tender to ensure that the successful bidder signs the contract and provides the required bonds. At the BSDQ it is mandatory for a tender of $100,000 or more and equals 10% of the price, unless the documents say otherwise. It takes the form of a bid bond with a surety’s letter of intent, or a transfer to the BSDQ’s account. A public body must require it for a contract estimated at $2,000,000 or more (C-65.1, r. 5, s. 11).

- The rules adopted by the ACQ, the CMEQ and the CMMTQ for filing, forwarding and accepting tenders through the BSDQ. The Code applies when the owner requires it or, failing that, to a tender for a covered specialty when the work is in Québec, more than one tender is requested, the price is $20,000 or more, and the documents allow comparable tenders. The contract must be made at the price and on the terms of the tender filed (s. J-1).

An occupation is construction work that falls within no trade, such as labourer. This distinction determines which competency certificate is required.
